Client: Any professional or individual legally capable under Articles 1123 et seq. of the French Civil Code, or any legal entity, who visits the website subject to these general terms and conditions.

Client Information: Hereinafter referred to as “Information(s),” encompassing all personal data that may be held by https://www.buddy.mu for the management of your account, customer relationship management, analysis, and statistical purposes.

Using the website https://www.buddy.mu implies full acceptance of the general terms of use described below. These terms may be modified or supplemented at any time; users of the website https://www.buddy.mu are therefore invited to consult them regularly.

The website is usually accessible to users at all times. However, https://www.buddy.mu may decide to interrupt access for technical maintenance, in which case it will make an effort to inform users of the dates and times of the intervention in advance. However, it reserves the right to suspend hosting services as briefly as possible for maintenance, infrastructure improvements, or in case of excessive or unusual traffic.

5. Intellectual Property and Counterfeiting

https://www.buddy.mu holds intellectual property rights and usage rights over all accessible elements on the website, including text, images, graphics, logos, videos, icons, and sounds. Any reproduction, representation, modification, publication, or adaptation of all or part of the website's elements, by any means or process, is prohibited without prior written permission from https://www.buddy.mu.

7. Management of Personal Data

The Client is informed of the regulations concerning marketing communication, the law of June 21, 2014, for trust in the Digital Economy, the Data Protection Act of August 6, 2004, as well as the General Data Protection Regulation (GDPR: No. 2016-679).

7.1 Data Collection Responsibility

For the Personal Data collected within the framework of the User’s personal account creation and their browsing on the Site, the entity responsible for processing Personal Data is Buddy Guide Ltd, represented by Astrid Bauwens, its legal representative.

As the data controller for the data it collects, https://www.buddy.mu undertakes to comply with the current legal framework. It is notably the Client's responsibility to determine the purposes for its data processing, provide prospects and clients with complete information on the processing of their personal data (following their consent collection), and maintain a treatment register that accurately reflects reality. Each time https://www.buddy.mu processes Personal Data, it takes all reasonable measures to ensure the accuracy and relevance of Personal Data regarding the purposes for which it processes them.

7.2 Purpose of Data Collection

https://www.buddy.mu may process all or part of the data:

To facilitate navigation on the Site and manage and track services ordered by the user: site connection data, usage data, billing, order history, etc.
To prevent and combat IT fraud (spamming, hacking…): browsing device, IP address, hashed password
To improve browsing on the Site: connection and usage data

https://www.buddy.mu does not market your personal data; they are solely used as necessary or for statistical and analytical purposes.

7.3 Right of Access, Rectification, and Opposition

In accordance with European regulations in effect, Users of https://www.buddy.mu have the following rights:

Right of access (Article 15 GDPR) and rectification (Article 16 GDPR), data updating, and completion of User data. Right to lock or delete User data (Article 17 GDPR) if inaccurate, incomplete, ambiguous, outdated, or if collection, use, disclosure, or storage is prohibited.
Right to withdraw consent at any time (Article 13-2c GDPR).

When https://www.buddy.mu learns of a User's death, it commits to destroying their data in the absence of any instructions, unless the retention is necessary for probative purposes or legal obligations.

7.4 Non-Disclosure of Personal Data

https://www.buddy.mu undertakes not to process, host, or transfer Client-collected Information to a country outside the European Union or one not deemed “adequate” by the European Commission without prior notice to the client. However, https://www.buddy.mu remains free to choose its technical and commercial subcontractors, provided they offer sufficient guarantees in compliance with the General Data Protection Regulation (GDPR: No. 2016-679).

https://www.buddy.mu commits to taking all necessary precautions to ensure the security of Information and prevent unauthorized access. However, if an incident affects the Client's Information integrity or confidentiality, https://www.buddy.mu will inform the Client promptly and communicate the corrective measures taken. Additionally, https://www.buddy.mu does not collect any "sensitive data."

User Personal Data may be processed by affiliates and subcontractors of https://www.buddy.mu (service providers) exclusively for the purposes of this policy.

In line with their respective roles and for the purposes mentioned above, the main people likely to access User data are primarily agents of our customer service team.

8. Incident Notification

Despite all efforts, no method of internet transmission or electronic storage is entirely secure. Therefore, we cannot guarantee absolute security. If we become aware of a security breach, we will inform the affected users so they can take appropriate measures. Our incident notification procedures comply with our legal obligations, whether national or European. We are committed to fully informing our clients about any issues impacting the security of their accounts and providing all necessary information to help them meet their regulatory reporting obligations.
